Terms of Service

1. Acceptance

These Terms govern your use of Farewell Pages websites, memorial pages, programme tools, contributor links, printable files, payment features, and related services (the “Service”). By creating an account, publishing or managing a memorial, submitting content, purchasing a feature, or using the Service, you agree to these Terms and the Privacy Policy.

If you act for a family, funeral home, church, organization, or other group, you represent that you have authority to accept these Terms on its behalf.

2. The Service

Farewell Pages may allow authorized users to create and share memorial announcements, service/arrangement information, online programmes, contributor invitations, photos/tributes, practical-support information, and printable programme files. Features vary by plan, region, memorial status, and availability.

3. Organizer responsibility

An organizer is responsible for:

• ensuring they have authority to create, manage, publish, or remove a memorial;
• verifying all names, dates, service details, contacts, programme content, and support instructions;
• obtaining required permissions for photos, tributes, readings, artwork, and other content;
• deciding what is public/private;
• protecting account credentials and contributor links; and
• reviewing final printable proofs.

Farewell Pages is not responsible for family disputes, authority disputes, or inaccuracies in organizer-supplied content.

4. Accounts and access

Provide accurate account information and protect your credentials. You are responsible for activity under your account. We may suspend or restrict access where reasonably necessary to protect users, the Service, legal compliance, or security.

5. Roles

Only authorized organizers may publish official facts, manage billing, publish support instructions, approve public submissions, or approve printable versions.

Contributor invitations grant only the limited scope displayed in the invitation. Contributors do not gain organizer, billing, event-management, private-record, or other contributor access.

Guests may view public content but may not circumvent access controls, scrape at scale, harvest data, harass users, or use memorials for commercial solicitation.

6. Content rules

You may not submit, publish, or use content that is unlawful, fraudulent, deceptive, defamatory, threatening, harassing, exploitative, hateful, abusive, privacy-invasive, infringing, malicious, spammy, or otherwise inappropriate for a respectful memorial setting.

We may remove, restrict, or preserve content where reasonably necessary to enforce these Terms, protect users, comply with law, or respond to claims.

7. Your content and permissions

You retain ownership of your submitted content. You grant Farewell Pages a non-exclusive, worldwide, royalty-free license to host, copy, process, format, display, transmit, create technical derivatives of, and otherwise use your content only as needed to provide, secure, improve, back up, and legally operate the Service.

You represent that you have all permissions needed to submit and publish your content. Public memorial content can be copied, screenshotted, and shared by recipients of its link.

8. Photos and tributes

Contributor submissions are private by default until an authorized organizer approves them for a selected purpose. Submission does not guarantee publication, inclusion in a programme, or retention. Organizers may approve, edit display details, hide, decline, delete, or choose not to use submissions, subject to applicable law.

Do not submit content you lack permission to share, including photographs of minors or vulnerable persons without appropriate authority.

9. Public links and public contacts

An organizer may publish memorial content through a public link and may choose whether selected contacts/support instructions are public. No-index or technical settings do not make an already shared link private.

10. Practical help and direct contribution instructions

Unless Farewell Pages expressly states otherwise in a separate written agreement, Farewell Pages does not receive, hold, custody, transfer, guarantee, insure, verify, or administer family contributions. Any transfer occurs directly between the sender and a destination selected by the organizer or a third party.

Farewell Pages is not a bank, payment institution, charity, trustee, fundraiser, or escrow provider for direct family contributions. Organizers are responsible for the accuracy and legitimacy of public instructions.

11. Paid features and refunds

Some features may require a fee. Prices, currency, tax treatment, inclusions, and availability will be shown before purchase. Payment processors may process transactions under their own terms.

Farewell Pages provides digital services, including memorial hosting, online programme tools, and downloadable programme files. Because these services may be activated, published, generated, downloaded, or otherwise delivered immediately, purchases are generally non-refundable once the relevant digital service has been delivered or materially used.

Before delivery of a paid service, a purchaser may contact Farewell Pages to request cancellation.

If a paid feature does not function substantially as described, Farewell Pages will first make reasonable efforts to correct the issue or provide the promised service. Where correction is not reasonable, Farewell Pages may, at its discretion and subject to applicable law, provide an equivalent service credit, replacement service, or refund.

Approved refunds will be issued to the original payment method. We aim to process approved refunds within 30 calendar days. The time for funds to appear in the purchaser's account may depend on the payment provider and financial institution.

This policy does not limit any refund rights that cannot legally be excluded.

A purchase grants the described entitlement; it does not guarantee permanent hosting or every future product feature unless expressly stated.

12. Printable programmes

Printable programme tools may create files from organizer-supplied content and approved selections. Organizers must review names, dates, spelling, photos, page content, service details, and proof layout before approval.

Where a final-approval/version-lock process exists, material changes after approval may require a new proof and approval. Printed output can vary by printer, paper, ink, equipment, and settings.

Do not represent a file as commercially print-ready unless Farewell Pages expressly states and verifies that it meets the relevant printer specifications.

13. Availability and archives

We may modify, suspend, or discontinue features for maintenance, security, legal compliance, or product evolution. We do not guarantee uninterrupted, error-free, permanent, or lossless service. Keep independent copies of important content and approved files.

Hosting, archive duration, and download availability may depend on the selected plan and terms shown at purchase or setup.

14. Intellectual property

Farewell Pages software, branding, templates, and design system are owned by us or our licensors. You may not copy, reverse engineer, resell, scrape, frame, or create a competing service from the Service except as permitted by law or written permission.

15. Disclaimer

The Service is provided on an “as is” and “as available” basis to the fullest extent permitted by law. Farewell Pages does not provide legal, medical, bereavement-counseling, religious, financial, funeral-director, printing, fundraising, or estate-administration advice.

We do not guarantee accuracy of user-supplied content, behavior of contributors/guests, operation of third-party links or payment destinations, privacy of a link after sharing, or exact printer reproduction.

16. Limitation of liability

To the fullest extent permitted by law, Farewell Pages and its affiliates, personnel, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, goodwill, data, or opportunity.

To the fullest extent permitted by law, our total liability for a claim relating to the Service will not exceed the greater of: (a) the amount you paid to Farewell Pages for the Service giving rise to the claim during the twelve months before the event giving rise to the claim; or (b) US$100.

This does not limit liability that cannot legally be excluded.

17. Indemnity

To the extent permitted by law, you agree to indemnify Farewell Pages from claims, losses, liabilities, costs, and expenses arising from your content, violation of these Terms, violation of another person's rights, lack of authority to publish/submit content, or unlawful use of the Service.

18. Termination

You may stop using the Service at any time. We may suspend or terminate access where reasonably necessary to protect the Service, users, rights holders, or legal compliance. Termination does not automatically remove public content already shared or records we must retain for legal, security, fraud, accounting, or dispute reasons.

19. Governing law and disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles, except where mandatory consumer or privacy law in your jurisdiction applies. Contact support@farewellpages.org first to seek resolution.

Any dispute not resolved informally shall be submitted to the state or federal courts located in Tarrant County, Texas. You consent to the exclusive jurisdiction of those courts, subject to any mandatory consumer-protection laws that may apply in your jurisdiction.
